Avni Er, turkish citizen held in Italy, is at risk of forced return to Turkey where they may face torture or other ill-treatment.
Avni Er is currently being held in a Center for identification and expulsion (CIE) in the city of Bari His lawyers have lodged an appeal against the refusal of his application for asylum and international protection. The European Court of Human Rights has ordered the Italian authorities not to proceed with the expulsion of Avni Er until the first instance decision on his request for asylum and international protection has been taken. His lawyers have asked the Court to extend the order until the decision on the appeal. In any case, there is a risk that the authorities Italian to proceed with the expulsion of Avni Er, before the appeal will be discussed.
Avni Er, who left Turkey in 1982 at the age of 11 years and there has never returned, was arrested on 1 April 2004 under an international police force against people suspected of crimes terrorism. He was convicted in December 2006 by a court of Assizes of Perugia for his membership in illegal organization Party-Front Revolutionary People's Liberation (DHKP-c) and sentenced to seven years in prison and deportation. In April 2007 the Turkish authorities have requested the extradition of Er in Turkey for its membership in the DHKP-C. The request was rejected by the authorities Italian for the risk that Er was tried twice for the same offense. In any case, the proceedings against Er are still pending in Turkey. Amnesty International believes that Avni Er is subjected to torture or other ill-treatment and an unfair trial if deported to Turkey, as happened to other members of the DHKP-C who were tortured and abused in recent years.
Under the international law principle of non-refoulement, Italy should not refer anyone to a country which could face torture or other ill-treatment or any other kind of violation of human rights.
